Professor Amber Polk’s article, Toxic Battery: Pollution as a Dignitary Tort, was published in Boston College Law Review. In this article, Polk argues that many of our exposures to toxic pollutants from factories, train derailments and their attendant chemical spills, through our use of consumer goods, and in the workplace constitutes an offensive battery, a violation of our right to be free from nonconsensual contacts.
