Professor Russell Gold’s article, The Price of Criminal Law, was published in the Arizona State Law Journal.
In this article, Gold argues that because the criminal legal system diffuses power and hides and offloads costs, officials and voters do not have to honestly consider how much criminal law enforcement they want. In short, we get more criminal law than we are willing to pay for. Criminal law inflicts tremendous suffering, so getting more enforcement than we’re willing to pay for is especially problematic.
